Terms of Use and Privacy Policy – Brazil

These Terms of Use and Privacy Policy applies to all Users of the services provided by ZenFly Tecnologias Ltda (“ZenFly”) or whose personal data is processed in any way by ZenFly. By using the services of ZenFly, you agree to this Terms of Use and Privacy Policy.

 

1. Services

1.1. ZenFly Tecnologias Ltda. (“ZenFly”), in partnership with Aeroportos Brasil Viracopos S.A. (“ABV”), provides a WhatsApp platform that allows users to check the status of flights operated at Viracopos International Airport and receive information and offers for products and services related to the airport.

1.2. To provide the service, we collect some personal data directly when you interact with the WhatsApp channel, such as: 1) whatsApp display name; 2) phone number and; 3) messages exchanged with the system.

 

2. Purpose of Data Processing

2.1. The processing of your personal data has the following purposes: a) to enable the use of the flight tracking service at Viracopos; b) to provide communications, products, and services related to your experience at the airport; c) to comply with legal and regulatory obligations (Brazilian General Data Protection Law – LGPD, art. 7, item IX) and; d) to protect the rights, security, and operations of ZenFly and ABV.

 

3. Data Sharing and Joint Controllership

3.1. ZenFly and ABV act as joint controllers of the personal data processed within this service. This means that both jointly determine how and for what purposes the data will be used.

3.2. ZenFly is responsible for collecting the data directly through the WhatsApp platform and registering user consent, storing it securely and making it available for audit.

3.3. ABV, upon receiving the data, undertakes to use it only for the purposes informed at the time of collection and may not use it for other purposes without obtaining new user consent.

3.4. The sharing of data with third parties will only occur in cases provided for by law or when authorized by ABV, always with appropriate information security and data protection measures.

 

4. Data Retention and Security

4.1. Your personal data is stored for as long as the flight tracking service at Viracopos is active or for the period required by law.

4.2. During this period, we carry out daily backups to protect your information and ensure it is securely available.

4.3. When the data is no longer necessary for the provision of the service, it will be deleted or anonymized. In some cases, legislation requires certain information to be retained for a longer period, which may be up to 10 (ten) years after the end of the service.

4.4. If a security incident involving your personal data occurs, you will be informed in accordance with the law, and all necessary measures will be taken to minimize possible impacts.

 

5. User Rights

As the data subject, you have rights guaranteed by the LGPD. This means that at any time you may request ZenFly to: a) confirm whether we process your data; b) access the information we have about you; c) correct inaccurate, incomplete, or outdated data; d) request the deletion or anonymization of unnecessary, excessive, or improperly processed data; e) request the portability of your data to another service provider, when technically feasible; f) be informed about who we share your data with; g) be informed about the possibility of not providing consent and the consequences of refusal; h) withdraw previously granted consent and; i) request a review of automated decisions that affect your interests.

6. Limitation of Liability

6.1. The ZenFly service is provided “as is,” without guarantees of uninterrupted operation, error-free performance, or freedom from viruses.

6.2. ZenFly and ABV are not responsible for: a) any failure to access or update flight information; b) damages caused by external factors such as power outages, internet problems, or actions by third parties and; c) user decisions regarding showing up for boarding. Users must always follow the instructions and notices provided by the airline.

 

7. Governing Law and Jurisdiction

This Terms of Use and Privacy Policy shall be governed by Brazilian law. In case of disputes, the competent forum will be the District Court of Campinas, State of São Paulo, with express waiver of any other, no matter how privileged.

 

8. Changes to this Policy

We may update this Terms of Use and Privacy Policy at any time. When this happens, the revised version will be published in this channel, and you may withdraw your consent if you do not agree with the changes.
